Hello! We thank you for using our services! We build them to help you improve your speed and quality of documentation in all health care settings. We look forward to creating a great community for all our users!

When we say “Company”, “we”, “our”, “us”, "docuSnippets", or "www.docusnippets.com" in this document, we are referring to Omegabyte Solutions LLC. When we say “Services”, we mean any product created and maintained by Omegabyte Solutions LLC. That includes all versions whether delivered within a web browser, desktop application, mobile application, or another format. When we say “You” or “your”, we are referring to the people or organizations that own an account (an “Account”) with one or more of our Services.

We may update these Terms of Service in the future. Whenever we make a significant change to our policies, we will also announce them on our company blog.

When you use our Services, now or in the future, you are agreeing to the latest Terms of Service. That's true for any of our existing and future products and all features that we add to our Services over time. There may be times where we do not exercise or enforce any right or provision of the Terms of Service; in doing so, we are not waiving that right or provision. These terms do contain a limitation of our liability. If you violate any of the terms, we may terminate your account. That's a broad statement and it means you need to place a lot of trust in us. We do our best to deserve that trust by keeping an open door to your feedback (support@docuSnippets.com).

Account Terms

1. To use certain features of our Services, you may be required to create a docuSnippets Account and provide us with a username, password, and certain other information about yourself as set forth in the Privacy Policy.

2. You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We do not have access to your password and no one will ask you for your password. Your password is encrypted and stored securely. It is your sole responsibility to keep your email, password, and other sensitive information confidential. If you become aware of any unauthorized use of your account or any other breach of security, you shall notify us immediately (support@docuSnippets.com).

3. You will not license, sell, or transfer your Account without our prior written approval.

4. You may not use the Services for any purpose outlined below:

  • Collect, harvest, mine or engage in any other activity to obtain e-mail addresses, phone numbers, personal information or any other information about other users in our Services.
  • Use or attempt to gain access to or use another’s user or Company Account, password, data, or computer systems or networks connected to any docuSnippets server, whether through hacking, password mining or any other means.
  • Access or attempt to access any Content that you are not authorized to access. Make available any files containing Content where you do not own or control, or have not received the necessary licenses to, all intellectual property rights, rights of privacy and publicity and all other rights in and to such Content.
  • Disrupt or interfere with the security of, or otherwise cause harm to our Services, docuSnippets’s Content, systems resources, accounts, passwords, servers or networks connected to or accessible through docuSnippets or any affiliated or linked sites.
  • Prepare, compile, use, download or otherwise copy any docuSnippets user directory or other user or usage information or any portion thereof, or transmit, provide or otherwise distribute (whether or not for a fee) such directory or information to any third party.
  • Market any goods or services for any business purpose (including advertising and making offers to buy or sell goods or services), unless specifically allowed to do so by docuSnippets.
  • Child exploitation, sexualization, or abuse: We don’t tolerate any activities that create, disseminate, or otherwise cause child abuse. Keep away and stop.
  • Violence, or threats thereof: If an activity qualifies as violent crime in the United States or where you live, you may not use docuSnippets Services to plan, perpetrate, or threaten that activity.
  • Hate speech: You cannot use our products to advocate for the extermination, domination, or oppression of people.
  • Harassment: Intimidating or targeting people or groups through repeated communication, including using racial slurs or dehumanizing language.
  • Doxing: If you are using docuSnippets products to share other peoples’ private personal information for the purposes of harassment, we don’t want anything to do with you.
  • Malware or spyware: Code for good, not evil. If you are using our products to make or distribute anything that qualifies as malware or spyware — including remote user surveillance — begone.
  • Spamming: No one wants unsolicited commercial emails. We don’t tolerate folks (including their bots) using our Services for spamming purposes. If your emails don’t pass muster with CAN-SPAM or any other anti-spam law, it’s not allowed.
  • Cybersquatting: We don’t like username extortionists. If you purchase a docuSnippets product account in someone else’s name and then try to sell that account to them, you are cybersquatting. Cybersquatting accounts are subject to immediate cancellation.
  • Infringing on intellectual property: You can’t use our Services to make or disseminate work that uses the intellectual property of others beyond the bounds of fair use.
  • Download any materials posted by another that you know, or reasonably should know, cannot be legally reproduced, distributed, performed or displayed in such manner.
  • Execute, facilitate, discuss, or otherwise complete financial transactions outside of the docuSnippets website related to events, conventions, and any other activity engaged in, established on, initiated on, or otherwise connected to docuSnippets.

5. You are responsible for all content posted and activity that occurs under your Account. That includes content posted by others who have access to your login credentials.

6. All users must be at least 13 years of age to use this platform. We do not create or produce content intended to reach an audience of children under the age of 13. Individuals under the age of 18 are required to have permission by their legal parent or guardian to use our Services.

7. You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

Payment, Refunds, and Plan Changes

1. If you are using the Beta version of our Services, it is really free: we do not ask you for your credit card and — just like for customers who pay for our Services — we do not sell your data.

2. For paid Services that offer a free trial, we explain the length of trial when you sign up. After the trial period, you need to pay in advance to keep using the Service. If you do not pay, we will freeze your account and it will be inaccessible until you make payment. If your account has been frozen for a while, we will queue it up for auto-cancellation.

3. If you are upgrading from a free plan to a paid plan, we will charge your card immediately and your billing cycle starts on the day of upgrade. For other upgrades or downgrades in plan level, the new rate starts from the next billing cycle.

4. We do not have access to your credit card information. We use the Stripe payment service, which handles all credit card transactions. We only utilize your Stripe ID to connect with the payment system on our Services and perform actions when necessary.

5. If you’re ever unhappy with our products for any reason, just contact our support team (support@docuSnippets.com) and we'll take care of you. We process refunds as outlined below:

  • If you tried one of our products for a 30 days and you just weren’t happy with it, you can have your money back.
  • If you were just charged for your next month of service but you meant to cancel, we’re happy to refund that extra charge.
  • If we had extended downtime (multiple hours in a day, or multiple days in a month) or you emailed customer service and it took multiple days to get back to you, we’d issue a partial credit to your account.
  • At the end of the day, nearly everything comes down to a case-by-case basis. Contact our support team (support@docuSnippets.com), tell us what's up, and we'll work with you to make sure you’re happy.

Cancellation and Termination

1. You are solely responsible for properly canceling your account. Within each of our Services, we provide a simple no-questions-asked cancellation link. An email or phone request to cancel your account is not automatically considered cancellation. If you need help cancelling your account, you can always contact our Support team (support@docuSnippets.com).

2. All of your content will be inaccessible from the Services immediately upon account cancellation. Within 30 days, all content will be permanently deleted from active systems and logs. Within 60 days, all content will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted. If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately, and you will not be charged again. We do not automatically prorate unused time in the last billing cycle.

3. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time. Suspension means you will not be able to access the account or any content in the account. Termination will furthermore result in the deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. We also reserve the right to refuse the use of the Services to anyone for any reason at any time. There are some things we strongly stand against and this clause is how we exercise that stance.

4. Verbal, physical, written or other abuse (including threats of abuse or retribution) of Company employee or officer will result in immediate account termination.

Modifications to the Service and Prices

1. We make a promise to our customers to support our Services forever (or until the last customer turns off the lights). That means when it comes to security, privacy, and customer support, we will continue to maintain all Services. Sometimes it becomes technically impossible to continue a feature or we redesign a part of our Services because we think it could be better or we decide to close new signups of a product. We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of our Services with or without notice.

2. Sometimes we change the pricing structure for our products. We may choose to change the prices for existing customers. If we do so, we will give at least 30 days notice and will notify you via the email address on record. We may also post a notice about changes on our websites or the affected Services themselves.

Uptime, Security, and Privacy

1. Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis.

2. We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. Of course, we'll reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.

3. We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet. There are some edge cases where we may send your data through our network unencrypted. You can contact our support team (support@docuSnipets.com) to report a security incident or threat.

4. When you use our Services, you entrust us with your data. We take that trust to heart. You agree that docuSnippets may process your data as described in our Privacy Policy and for no other purpose. We as humans can access your data for the following reasons:

  • To help you with support requests you make. We'll ask for express consent before accessing your account.
  • On the rare occasions when an error occurs that stops an automated process partway through. We get automated alerts when such errors occur. When we can fix the issue and restart automated processing without looking at any personal data, we do. In rare cases, we have to look at a minimum amount of personal data to fix the issue. In these rare cases, we aim to fix the root cause as much as possible to avoid the errors from reoccurring.
  • To safeguard docuSnippets. We'll look at logs and metadata as part of our work to ensure the security of your data and the Services as a whole. If necessary, we may also access accounts as part of an abuse report investigation.
  • To the extent required by applicable law. As a US company with all data infrastructure located in the US, we only preserve or share customer data if compelled by a US government authority with a legally binding order or proper request under the Stored Communications Act. If a non-US authority approaches docuSnippets for assistance, our default stance is to refuse unless the order has been approved by the US government, which compels us to comply through procedures outlined in an established mutual legal assistance treaty or agreement mechanism. If docuSnippets is audited by a tax authority, we only share the bare minimum billing information needed to complete the audit.

5. We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services.

6. Under the California Consumer Privacy Act (“CCPA”), docuSnippets is a “service provider”, not a “business” or “third party”, with respect to your use of the Services. That means we process any data you share with us only for the purpose you signed up for and as described in these Terms of Service and Privacy policy. We do not retain, use, disclose, or sell any of that information for any other commercial purposes unless we have your explicit permission. And on the flip-side, you agree to comply with your requirements under the CCPA and not use docuSnippets’s Services in a way that violates the regulations.

Copyright and Content Ownership

1. The Services may contain information, text, links, graphics, photos, videos, audio, streams, or other materials (“Content”), including Content created with or submitted to the Services by you or through your Account (“Your Content”). We take no responsibility for and we do not expressly or implicitly endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any of Your Content.

2. All Content posted on the Services must comply with U.S. copyright law. docuSnippets will investigate notices of copyright infringement and take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) (“DMCA”). If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on our Services or on sites linked to from us, please contact our Support team(support@docuSnippets.com) with the following elements:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is alleged to have been infringed;
  • A description of the copyrighted work or works that you claim have been infringed and identification of what content in such work(s) is claimed to be infringing and which you request to be removed or access to which is to be disabled;
  • A description of where the content that you claim is infringing is located on at; Information sufficient to permit docuSnippets to contact you, such as your physical address, telephone number, and e-mail address;
  • A statement by you that you have a good faith belief that the use of the content identified in your Notice in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement by you that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

3. By submitting Your Content to our Services, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to Your Content contained within these Terms. Because you alone are responsible for Your Content, you may expose yourself to liability if you post or share Content without all necessary rights.

4. You retain any ownership rights you have in Your Content, but you grant docuSnippets the following license to use that Content

  • When Your Content is created with or submitted to the Services, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, copy, modify, adapt, prepare derivative works of, distribute, store, perform, and display Your Content and any name, username, voice, or likeness provided in connection with Your Content in all media formats and channels now known or later developed anywhere in the world. This license includes the right for us to make Your Content available for syndication, broadcast, distribution, or publication by other companies, organizations, or individuals who partner with docuSnippets. You also agree that we may remove metadata associated with Your Content, and you irrevocably waive any claims and assertions of moral rights or attribution with respect to Your Content.
  • Any ideas, suggestions, and feedback about docuSnippets or our Services that you provide to us are entirely voluntary, and you agree that docuSnippets may use such ideas, suggestions, and feedback without compensation or obligation to you.

5. Unless otherwise stated, docuSnippets owns the intellectual property rights in the website and Content on the website.

6. We do not pre-screen Content, but reserve the right (but not the obligation) in our sole discretion to refuse or remove any Content that is available via the Service.

7. The names, look, and feel of the Services are copyright© to the Company. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company. You must request permission to use the Company's logo or any Service logos for promotional purposes. Please email us(support@docuSnippets.com) requests to use logos. We reserve the right to rescind this permission if you violate these Terms of Service.

8. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by the Company.

9. You must not modify another website so as to falsely imply that it is associated with the Services or the Company.

International Users

Our Services can be accessed from countries around the world. This website is controlled and operated by docuSnippets from within the United States of America. We make no guarantee that materials or services on this website are appropriate for use in other countries. If you access this site from outside the United States, you are responsible for compliance with all local laws.

Links to Third-Party Sites

docuSnippets may include links that will take you to other sites outside of the our Services. Linked sites are not an endorsement from docuSnippets nor can we realistically find and monitor all links on the website created by users. You understand that by using this site, you are responsible for the actions you take and that docuSnippets is not responsible for any of the contents found on any linked site nor any form of transmission from linked sites

We design our Services with care, based on our own experience and the experiences of customers who share their time and feedback. However, there is no such thing as a service that pleases everybody. We make no guarantees that our Services will meet your specific requirements or expectations.

Liability

We mention liability throughout these Terms but to put it all in one section:
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to this Terms of Service or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
In other words: choosing to use our Services does mean you are making a bet on us. If the bet does not work out, that's on you, not us. We do our best to be as safe a bet as possible through careful management of the business; investments in security, infrastructure, and talent.
